New Executive Order Aims to Limit State Interference in U.S. Energy Policy

On April 8, 2025, the White House announced a new Executive Order titled “Protecting American Energy from State Overreach.” This directive calls on the U.S. Attorney General to review and identify state and local laws, regulations, policies, and practices that may hinder the development or use of domestic energy resources—especially those potentially unconstitutional, preempted by federal law, or otherwise unenforceable. The order places particular emphasis on state and local actions related to climate change, ESG (Environmental, Social, and Governance) initiatives, environmental justice, greenhouse gas regulations, and any programs that impose carbon penalties or taxes.

The National Propane Gas Association (NPGA) is actively engaged with the White House regarding this pivotal directive. NPGA is currently assembling a detailed, state-by-state list of laws and policies it believes warrant federal review and possible revocation. Once compiled, NPGA plans to collaborate with the Attorney General’s office to challenge and help roll back any measures deemed overly restrictive or unconstitutional.
